1. Acceptance of Terms
By accessing or using Posterly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and 9vil ("we", "us", "our").
2. Description of Service
Posterly is an AI-powered platform that enables users to create marketing posters, social media graphics, and other visual content. The Service includes:
- AI-driven poster generation from text prompts
- Customizable design templates
- Brand kit management for consistent branding
- Export in multiple formats (PNG, JPEG, PDF)
- Project storage and management
- Sharing and collaboration features
3. Accounts & Eligibility
Account Creation
You may create an account using your email address or through third-party authentication providers (Google, Apple, Facebook). You are responsible for maintaining the security of your account credentials.
Guest Mode
You may use the Service without creating an account in guest mode. Guest data is stored locally on your device. We are not responsible for data loss if you uninstall the app or clear device storage before creating an account.
Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
4. User Content & Ownership
You retain all ownership rights to content you create using the Service, including:
- Text prompts and descriptions you provide
- Images, logos, and assets you upload
- AI-generated posters and designs created from your prompts
- Brand kit configurations and custom templates
By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing and improving the Service.
5. AI-Generated Content
Important: While you own the designs generated by our AI, you are responsible for ensuring that your use of these designs complies with applicable laws, including copyright, trademark, and publicity rights.
Regarding AI-generated content:
- You own the output generated from your prompts
- We do not claim ownership of AI-generated designs
- AI output may occasionally resemble existing works — we do not guarantee uniqueness
- You are responsible for verifying that generated content does not infringe third-party rights before commercial use
- We reserve the right to improve our AI models using anonymized, aggregated usage patterns
6. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Create designs that infringe upon intellectual property rights of third parties
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Use automated tools to access the Service in excess of normal usage patterns
- Resell or redistribute the Service without written authorization
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Transmit viruses, malware, or other harmful code through the Service
We reserve the right to suspend or terminate accounts that violate these terms.
7. Subscriptions & Billing
Free Tier
The Service offers a free tier with limited monthly poster generations and basic features. Usage limits are specified within the app and may change with notice.
Paid Subscriptions
Paid plans provide additional generations, premium templates, and priority processing. Subscription fees are billed through the applicable app store (Apple App Store or Google Play Store) and are subject to their respective billing policies.
Cancellation
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
8. Intellectual Property
The Service, including its software, design, logos, trademarks, and documentation, is the intellectual property of 9vil and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited usage rights expressly provided.
The Posterly name, logo, and brand identity are trademarks of 9vil. You may not use these trademarks without prior written consent.
9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content is provided without guarantee of accuracy, originality, or suitability for any particular purpose.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 9VIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
10. Termination
You may terminate your account at any time by contacting us or through the app settings. Upon termination:
- Your access to the Service will cease
- We will delete your account data within 30 days, except where retention is required by law
- You may request export of your projects before deletion
We may suspend or terminate your access if you violate these Terms, with or without prior notice depending on the severity of the violation.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 9vil operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
12. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will notify you through the app or via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
